1. Acceptance of Terms

By downloading, installing, or using Wyvern ("the Software") and its associated website (wyvern-pc.com), you agree to be bound by these Terms of Service. If you do not agree, you must discontinue use immediately. These terms constitute a legally binding agreement between you and Wyvern.

2. Description of Service

  • Wyvern is a Windows desktop application providing system management, privacy protection, and optimization tools.
  • Core features include: Real-Time Dashboard (hardware monitoring, BSOD detection, uptime tracking), System Optimize (ManagePC, BoostMode, Smart Cleanup), Privacy Tools (SilentApp, HideTrayIcon, PinTop), Activity Tracker (execution history, browsing history, uninstall history), Hardware Identity Privacy Tool (ID Privacy Mode, HWID Info, Advanced Hardware Identity Privacy Tool), File Tools (FileTimeChanger, Smart Explorer), VanishData (secure disk wiping), Force Shutdown, and Auto Shutdown.
  • The Software is designed exclusively for personal use on Windows operating systems. It is not intended for enterprise, government, or commercial environments unless explicitly authorized.

3. Eligibility

  • You must be at least 14 years of age to use the Software. Users under 18 require parental or guardian consent.
  • You must have legal authority to agree to these terms in your jurisdiction.
  • You are responsible for ensuring that use of the Software complies with all applicable local, state, national, and international laws and regulations.

4. Account Registration

  • To access certain features, you must create an account with a valid email address.
  • You must provide accurate, complete, and current information during registration.
  • You are solely responsible for maintaining the confidentiality of your account credentials.
  • You must notify us immediately at support@wyvern-pc.com upon discovering any unauthorized use of your account.
  • Account sharing, selling, or transferring to third parties is strictly prohibited.
  • We reserve the right to suspend or terminate accounts that contain false information or violate these terms.

5. Subscription Plans & Billing

  • Wyvern offers a Free plan and a paid Plus plan. The Free plan provides limited access to features with time-restricted tool sessions. The Plus plan unlocks all features without restrictions.
  • Plus subscriptions are available in monthly, quarterly, and annual billing cycles. Prices are displayed at the time of purchase and may be subject to change with 30 days' prior notice.
  • Payments are processed securely through third-party payment providers (e.g., Stripe, PayPal). Wyvern does not store your full payment card details.
  • Subscriptions automatically renew at the end of each billing cycle unless cancelled before the renewal date. You may cancel at any time from your account settings.
  • Refund policy: You may request a full refund within 7 days of purchase if the Software has not been excessively used or abused. Refund requests are reviewed on a case-by-case basis. To request a refund, contact support@wyvern-pc.com.
  • If a payment fails or is disputed, your subscription may be downgraded to the Free plan immediately.

6. Acceptable Use

  • You agree to use Wyvern only for lawful purposes and in accordance with these terms.
  • You must NOT use the Software to: (a) violate any applicable law, regulation, or third-party rights; (b) engage in unauthorized access to systems you do not own; (c) circumvent software licensing, anti-cheat systems, or digital rights management; (d) facilitate fraud, identity theft, or impersonation; (e) distribute malware or engage in any form of cyberattack.
  • Hardware Identity Privacy Tool features (ID Privacy Mode, Advanced Hardware Identity Privacy Tool) are provided for privacy protection and testing purposes ONLY. Using these features to evade bans, circumvent licensing, commit fraud, or for any illegal purpose is strictly prohibited.
  • VanishData (secure wiping) is intended for personal data sanitization. You must ensure you have the legal right to erase data on any drive you wipe.
  • Activity Tracker is designed for personal forensic analysis of your own computer. Monitoring others' activity without their consent may violate privacy laws in your jurisdiction.
  • Any violation of this section may result in immediate account termination without refund.

7. Hardware Identity Privacy Tool — Prohibited Uses & Anti-Cheat Policy

  • Wyvern's Hardware Identity Privacy Tool (including ID Privacy Mode and Advanced Hardware Identity Privacy Tool) modifies hardware identifiers stored in the Windows registry at the user-mode level. These features are designed exclusively for the purpose of protecting the user's personal hardware identity and privacy on their own system.
  • STRICTLY PROHIBITED USES: You must NOT use the Hardware Identity Privacy Tool for any of the following purposes: (a) evading or circumventing hardware bans, suspensions, or restrictions imposed by any online game, gaming platform, game publisher, or anti-cheat system (including but not limited to EasyAntiCheat, BattlEye, Vanguard, FACEIT Anti-Cheat, PunkBuster, nProtect GameGuard, XIGNCODE, or any other anti-cheat solution); (b) bypassing, defeating, interfering with, or rendering ineffective any anti-cheat software, kernel-level anti-cheat drivers, or cheat detection mechanisms; (c) facilitating or enabling cheating, hacking, exploiting, or gaining unfair advantages in any online or multiplayer game; (d) evading account bans, device bans, IP bans, or any other enforcement actions taken by game developers, publishers, or platform operators; (e) creating multiple accounts ("smurfing") or circumventing matchmaking restrictions using altered hardware identifiers; (f) circumventing or bypassing any software licensing system, digital rights management (DRM), hardware-based authentication, or device-binding mechanisms; (g) committing fraud, identity theft, impersonation, or misrepresentation of device identity to any third-party service; (h) evading detection, investigation, or enforcement by law enforcement agencies or regulatory authorities; (i) any other purpose that violates the terms of service of any third-party software, platform, or online service.
  • INTENDED LEGITIMATE USES: The Hardware Identity Privacy Tool is intended solely for: (a) protecting personal hardware fingerprint data from unauthorized tracking or profiling; (b) preventing unwanted hardware-based identification by websites, advertisers, or data brokers; (c) testing and development purposes on systems you own or are authorized to test; (d) restoring privacy after selling, donating, or repurposing hardware; (e) educational and research purposes related to system privacy.
  • USER RESPONSIBILITY AND LEGAL COMPLIANCE: You are solely responsible for ensuring that your use of the Hardware Identity Privacy Tool complies with all applicable local, national, and international laws, as well as the terms of service of any third-party software or services you use. Wyvern does not endorse, encourage, or support any use of its features that violates third-party terms of service or applicable laws. You acknowledge that using hardware identity modification tools in connection with anti-cheat protected games may violate the terms of service of those games and could result in permanent bans imposed by the respective game developers or publishers.
  • ENFORCEMENT: Any violation of this section will result in immediate and permanent termination of your Wyvern account without prior notice and without refund. Wyvern reserves the right to cooperate with law enforcement agencies, game developers, anti-cheat providers, and other third parties in investigating suspected misuse. Wyvern may implement technical measures to detect and prevent prohibited uses of the Hardware Identity Privacy Tool.
  • NO WARRANTY FOR PROHIBITED USES: Wyvern provides absolutely no warranty, support, or assistance for any use of the Hardware Identity Privacy Tool that falls outside the intended legitimate uses described above. If your account with any third-party service is suspended or banned as a result of using this tool in violation of their terms of service, Wyvern bears no responsibility or liability whatsoever.
  • INDEMNIFICATION FOR MISUSE: You agree to indemnify, defend, and hold harmless Wyvern from any and all claims, damages, liabilities, costs, and expenses (including legal fees) arising from your misuse of the Hardware Identity Privacy Tool, including but not limited to claims from game developers, anti-cheat providers, platform operators, or any other third party.

8. Intellectual Property

  • All rights, title, and interest in and to the Software, including but not limited to source code, object code, design, graphics, logos, UI/UX, documentation, and all related intellectual property, are exclusively owned by Wyvern and its licensors.
  • You are granted a limited, non-exclusive, non-transferable, revocable license to use the Software for personal, non-commercial purposes.
  • You may NOT: reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Software; modify, adapt, translate, or create derivative works; redistribute, sublicense, rent, lease, or sell the Software or any part thereof; remove or alter any proprietary notices, labels, or marks.
  • User-generated content (e.g., profile information) remains the property of the respective user, but you grant Wyvern a limited license to use such content solely for operating the service.

9. Privacy & Data

Your use of the Software is also governed by our Privacy Policy, available at wyvern-pc.com/privacy. By using Wyvern, you consent to the collection, processing, and use of data as described in the Privacy Policy. We collect minimal data necessary to operate the service, including anonymous error reports and usage analytics to improve software quality.

10. Software Updates

  • Wyvern may release updates, patches, or new versions at its discretion. Updates may be delivered automatically.
  • Continued use of the Software after an update constitutes acceptance of any changes or new features.
  • We do not guarantee backward compatibility or continued support for older versions.

11. Suspension & Termination

  • We reserve the right to suspend or terminate your account and access to the Software at any time if: you violate these Terms; you engage in abusive, fraudulent, or illegal activity; your actions pose a risk to other users or the integrity of the service.
  • Upon termination, your right to use the Software ceases immediately. Data associated with your account may be deleted after 30 days.
  • You may terminate your account at any time by contacting support@wyvern-pc.com. Active paid subscriptions will not be automatically refunded upon voluntary termination.

12. Disclaimer of Warranties

  • THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
  • We do not warrant that the Software will be uninterrupted, error-free, or free from harmful components.
  • Hardware Identity Privacy Tool features modify system identifiers temporarily or persistently. While designed to be reversible, Wyvern does not guarantee that all changes can be reverted in every scenario. Use at your own risk.
  • VanishData performs irreversible data destruction. Wyvern is not responsible for any unintended data loss resulting from the use of this feature.

13. Limitation of Liability

  • TO THE MAXIMUM EXTENT PERMITTED BY LAW, Wyvern and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, business interruption, or system damage, arising from your use of or inability to use the Software.
  • Our total cumulative liability shall not exceed the amount you paid for the Software in the 12 months preceding the claim.
  • Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law.

14. Indemnification

You agree to indemnify, defend, and hold harmless Wyvern and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Software, violation of these Terms, or violation of any third-party rights.

15. Third-Party Services

  • The Software may integrate with or rely on third-party services (e.g., Supabase for authentication, Stripe/PayPal for payments, Vercel for hosting).
  • Wyvern is not responsible for the availability, accuracy, or practices of any third-party services. Your use of such services is governed by their respective terms and privacy policies.

16. Governing Law & Dispute Resolution

  • These Terms shall be governed by and construed in accordance with the laws of the Republic of Korea, without regard to conflict of law principles.
  • Any dispute arising from or relating to these Terms or the Software shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to the competent courts of the Republic of Korea.

17. Modifications to Terms

  • We reserve the right to modify these Terms at any time. Changes will be posted on the website and, where practicable, notified via email or in-app notification.
  • Material changes will take effect 30 days after posting. Non-material changes take effect immediately.
  • Continued use of the Software after changes constitutes acceptance. If you do not agree with modified terms, you must stop using the Software.

18. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

19. Entire Agreement

These Terms, together with the Privacy Policy and any applicable subscription agreement, constitute the entire agreement between you and Wyvern regarding the use of the Software and supersede all prior agreements or understandings.
